Data Protection Officer หรือ DPO (เจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคล) มีบทบาทในการดูแลรักษาข้อมูลส่วนบุคคลทั้งภายในและภายนอกองค์กร อาทิเช่น ข้อมูลของพนักงาน หรือข้อมูลของลูกค้า ตั้งแต่การรวบรวม จัดเก็บ เปิดเผยและการนำข้อมูลออกไปใช้
คุณสมบัติของ DPO
มีความเข้าใจเกี่ยวกับกฎหมายคุ้มครองข้อมูลส่วนบุคคล
มีความรู้ความเข้าใจเกี่ยวกับโครงสร้างด้าน IT และโครงสร้างทางเทคนิคขององค์กร
มีความสามารถในการปกป้องข้อมูลและปฏิบัติตามข้อกำหนดของกฎหมาย PDPA
ต้องเป็นบุคคลในองค์กรเพื่อที่จะสามารถเข้าถึงกับทุกคนในองค์กรได้
ต้องไม่มีผลประโยชน์ทับซ้อนกับตำแหน่งเดิมที่ได้รับมอบหมาย หรือตำแหน่งที่มีความเกี่ยวข้องกับการเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคล
หน้าที่สำคัญของเจ้าหน้าที่ DPO มีด้วยกันหลักๆอยู่ 3 ข้อ ดังนี้
ให้นำแนะนำ DPO จะต้องมีความรู้ความเข้าใจเกี่ยวกับกฎหมาย PDPA และให้คำแนะนำ เป็นที่ปรึกษาให้แก่องค์กร พนักงาน และบุคคลที่เกี่ยวข้อง ให้สามารถประมวลผลข้อมูลส่วนบุคคลให้ถูกต้องตามกฎหมาย PDPA
การควบคุมภายในองค์กร DPO จะต้องเป็นผู้ประสานงานกับแผนกต่างๆภายในองค์กร เพื่อสร้างความรู้และความเข้าใจเกี่ยวกับกฎหมาย PDPA และต้องตรวจสอบการประมวลผลข้อมูลส่วนบุคคลของในแต่ละแผนกว่าดำเนินการถูกต้องตามกฎหมาย PDPA หรือไม่?
การติดต่อประสานงานกับองค์กรภายนอก DPO จะเป็นผู้ติดต่อประสานงานกับเจ้าของข้อมูล กรณีที่มีการขอใช้สิทธิของเจ้าของข้อมูล และเป็นผู้ติดต่อประสานงานกับคณะกรรมการคุ้มครองข้อมูลส่วนบุคคลในกรณีที่เกิดปัญหาขึ้นภายในองค์กร
DPO ต้องมีความรู้ความเชี่ยวชาญเกี่ยวกับกฎหมาย PDPA ยิ่ง DPO สามารถทำหน้าที่อย่างเต็มประสิทธิภาพมากเท่าไหร่ ก็จะช่วยให้องคกรใช้ข้อมูลส่วนบุคคลอย่างถูกต้อง และป้องกันปัญหาที่จะเกิดขึ้นได้ด้วย

Features of DPOs

There are 3 main duties of DPO officers as follows:
1. To make recommendations, DPOs must have knowledge of PDPA laws and make recommendations. To be a consultant to the organization, employees and related persons To be able to process personal data in accordance with PDPA laws
2. Internal Controls The DPO must coordinate with the various departments within the organization. To create knowledge and understanding of the PDPA law and to verify that the processing of personal data of each department is carried out in accordance with the PDPA law or not?
3. Liaison with external organizations The DPO is the liaison with the data subject. In case of requesting to exercise the rights of the data subject and is the contact person to coordinate with the Personal Data Protection Committee in case of problems occurring within the organization
